Combined, the attorneys of Schindler Eyrich | LLP have over 35 years’ experience representing beneficiaries, trustees, executors, personal representatives, guardians and other fiduciaries, creditors, interested parties and other clients in trust, estate and fiduciary matters. Our representation includes strategic pre-dispute counseling, litigation, administration, adversarial hearings and trials, alternative dispute resolution, and appeals.
We advise trustees, executors and other fiduciaries in an effort to satisfy their fiduciary responsibilities and avoid claims, including seeking instructions by the Court where appropriate or required. We also represent fiduciaries in connection with claims involving their management and administration of assets entrusted to them, fiduciaries caught between the conflicting claims of competing groups of beneficiaries, and fiduciaries responding to claims asserted by third parties.
In addition, we represent clients regarding the scope of a fiduciary’s authority and their compliance with duties under governing instruments and applicable law. We represent parties in good faith contests of the validity of wills and trust instruments, as well as the defense of such challenges. We also represent parties in cases where the meaning of a will or trust instrument is unclear and subject to multiple interpretations in order to ascertain the true intent. In addition, we represent clients in actions to retain or recover property claimed to be wrongfully taken or belong to another person, and clients affected by the misuse of a power of attorney.
